Terms of Service

Welcome to My Moment. By downloading, installing, or using the My Moment iOS app (the "App") or this website, you agree to these Terms of Service (the "Terms"). If you don't agree, please don't use the App. These Terms also incorporate Apple's Standard EULA for App Store apps (the "Apple EULA"), which Apple requires us to reference here.
1. Who you're agreeing with
My Moment is operated by Team ACMW. Throughout these Terms, "we", "us", and "our" refer to Team ACMW. "You" means you, the person using the App.
2. Eligibility
You must be at least 13 years old (or 16 in the EEA) to use the App. By using the App you confirm that you can form a binding contract with us under your local law.
3. Your account
You can sign in with Apple, Google, or a one-time email magic link. You're responsible for keeping access to your sign-in method secure. If you lose access to your email and sign-in providers, we may not be able to recover your account.
4. Beta program
While the App is in beta (TestFlight or otherwise), it is offered "as is" and may contain bugs, missing features, or change without notice. Please don't store information in the beta that you couldn't afford to lose.
5. Your content
Your journal entries belong to you. We do not claim ownership over them and we do not store them on our servers (see the Privacy Policy for the full picture). You're responsible for what you record. Don't use the App to store other people's personal data without their consent, and don't use it for anything illegal.
6. Acceptable use
- Don't reverse-engineer, decompile, or disassemble the App except to the extent the law allows.
- Don't try to break, overwhelm, or work around the App's security or rate limits.
- Don't use the App to harass, threaten, or harm anyone.
- Don't impersonate others when signing up for the beta.
We may suspend or terminate accounts that misuse the App.
7. Subscriptions and payments
My Moment is currently free. If we add paid features in the future, the prices and terms will be presented in-app and processed by Apple. Refunds are governed by Apple's App Store policies.
8. Third-party services
The App relies on a small set of third parties to function — for example, Supabase for sign-in, and Apple / Google for authentication. Those services have their own terms, and we aren't responsible for what they do with the information you provide directly to them.
9. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We don't promise the App will be error-free or uninterrupted.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the App. Our total liability to you for any claim related to the App will not exceed the amount you paid us in the twelve months before the claim arose, or USD 10 if you haven't paid us anything.
11. Termination
You can stop using the App at any time and delete your account from Settings → Delete Account. We may suspend or terminate your access if you breach these Terms. Sections 5, 9, 10, 12, and 13 survive termination.
12. Changes to the App and these Terms
We may update the App and these Terms over time. If a change is material we'll update the date at the top of this page and, where appropriate, notify you in-app or by email before it takes effect. Continuing to use the App after a change means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law rules. Disputes will be resolved in the courts of Hong Kong, except where mandatory consumer-protection laws of your country of residence say otherwise.
14. Apple-specific terms
The following terms apply because the App is distributed via the Apple App Store, and are required by Apple:
- These Terms are between you and Team ACMW only — not with Apple. Apple is not responsible for the App or its content.
- Your licence to use the App is limited to a non-transferable licence to use it on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service.
- We are solely responsible for providing maintenance and support for the App. Apple has no obligation to provide any maintenance or support.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
- We — not Apple — are responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including product liability, legal compliance, or intellectual property claims.
- If a third party claims the App or your use of it infringes their intellectual property rights, we — not Apple — will be solely responsible for the investigation, defence, settlement, and discharge of that claim.
- You represent that (i) you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and (ii) you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
